Copyright and Intellectual Property Policy

Effective Date: January 1, 2025 At Advariation ("we," "us," or "our"), we respect intellectual property rights and are committed to conducting our creative services with transparency, professionalism, and legal diligence. This policy governs the ownership, usage, licensing, and responsibilities associated with creative assets produced by Advariation and assets provided by clients (“you” or “Client”). I. Ownership of Creative Work

Upon full payment of all invoices related to the project, the Client is granted a non-exclusive, non-transferable license to use the final delivered creative assets for the agreed-upon, intended commercial purposes (e.g., digital advertising, social media, or other marketing campaigns).

Unless otherwise agreed in writing, Advariation retains ownership of:

  • All working files and native project files (e.g., Adobe, Figma, HTML5 source files).
  • Conceptual drafts, rejected versions, and internal notes created during production.
  • Underlying frameworks or templates used to create the assets (e.g., reusable animation templates or coding frameworks).

Working files may be licensed separately at our discretion for an additional fee.

II. Client-Provided Assets & Third-Party Materials

Clients are solely responsible for ensuring that they have full legal rights, licenses, and permissions to use and distribute all assets they provide to Advariation, including but not limited to:

  • Logos and trademarks
  • Images and illustrations
  • Fonts and typefaces
  • Audio (music, voiceovers, sound effects)
  • Video clips or b-roll
  • Scripts, copy, or brand messaging
  • Brand guidelines
  • Talent or likenesses (including influencer or celebrity content)

Advariation will not be held liable for any copyright infringement, trademark disputes, right-of-publicity claims, or license violations related to client-provided materials.

If stock assets or licensed elements are required, Clients must either (a) supply them with proof of license, or (b) request Advariation to license them on their behalf at an additional cost.

III. Usage Rights & Limitations

Unless otherwise stated in writing, usage of final creative assets is limited to:
  • The original campaign or project scope
  • The specified platforms (e.g., Meta Ads, Google Ads, TikTok)
  • The territory and duration outlined in the proposal or discovery process
 
Prohibited Uses:
  • Redistribution or resale of Advariation-created assets or template.
  • Use in illegal, defamatory, or unethical advertising.
  • Use outside the original scope without additional licensing (e.g., turning an ad into a TV commercial or billboards if only digital rights were granted)
Modifications: Clients may edit or adapt the final creative assets for internal use, but Advariation is not responsible for the outcome of those changes, especially if they affect performance, branding, or compliance.
